What happens to HP - surely they are at fault too, for taking what they surely knew was confidential information?

I’m not sure what the law is. It probably depends on whether they received the information knowingly or unknowingly.

I can’t take a generous view of either the person who gave out the info or the employer who received it. Unfortunately, in the course of my non-career,I have come across several people who think nothing of carrying documents from their ex-employers to their new ones. One helpless soul even produced a template from his employer at a job interview!
